1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of keelkit.dev (the "Site") and your purchase of a Keel source-code license. They're between you and Mohsin Akram, operating as Keel ("we", "us", "our"). By browsing the Site, submitting the contact form, or purchasing a license, you agree to these Terms. The license you receive when you purchase Keel is governed separately by the Keel End User License Agreement (LICENSE.md, included with your download); where the two overlap, the License Agreement controls what you may do with the source code, and these Terms govern the Site and the purchase itself.
2. Definitions
"Service" means the Site and the purchase, download, and support flows it provides. "Product" means the Keel source code you receive on purchase. "Order" means a completed purchase of a Solo, Studio, or Agency license through our checkout. "You" means the person or entity that browses the Site or places an Order.
3. Accounts and eligibility
The Site itself does not require you to create an account, we don't operate user sign-ups here. You must be at least 18 years old, or the age of majority in your jurisdiction, to place an Order. If you're purchasing on behalf of a company, you're representing that you have authority to bind that company to these Terms.
4. Acceptable use
You may not: scrape or systematically extract Site content for a competing product; attempt to bypass or interfere with checkout, rate limiting, or repo-access automation; use the contact form to send spam, malware links, or abusive content; or misrepresent your GitHub username during checkout to gain repository access you haven't paid for. We reserve the right to refuse an Order or revoke repository access granted under it if we reasonably believe it was obtained through misuse of this kind.
5. Purchases, pricing, and payment
All Keel licenses are one-time purchases (see the pricing page for current tiers and prices), not subscriptions, there's no recurring billing. Payment is processed entirely by LemonSqueezy, our merchant of record: LemonSqueezy handles your card details, receipt, applicable sales tax/VAT, and the transaction itself, we never see or store your payment information. Prices are shown in USD and may change at any time; the price at checkout is the price you pay. Studio and Agency purchases additionally collect your GitHub username at checkout, used solely to grant you collaborator access to the private Keel repository.
6. Refunds and cancellation
We offer a 14-day, no-questions-asked refund from the date of purchase. Email support@keelkit.dev with your order details to request one. Once a refund is issued, your license terminates under the terms of the License Agreement (LICENSE.md, bundled with your download), and any GitHub repository access granted under a Studio or Agency license is revoked. There's nothing to "cancel" beyond a refund request, since there's no recurring subscription to stop.
7. Intellectual property
The Site's design, copy, and branding, and the Keel source code itself, are owned by us and licensed to you only as described in the License Agreement you receive on purchase. Nothing on the Site or in these Terms grants you rights to the Keel trademark, name, or branding beyond referencing that your product was built with Keel.
8. User content
If you submit a message through the contact form, you're granting us the right to use it solely to respond to you and, where relevant, to improve the product or Site. We don't publish contact-form submissions.
9. Third-party services
Checkout runs through LemonSqueezy, subject to LemonSqueezy's own terms and privacy policy. Repository access for Studio and Agency runs through GitHub; using that access means you're also bound by GitHub's Terms of Service. We're not responsible for these third parties' own policies or availability.
10. Disclaimers and warranties
The Site and the ordering process are provided "as is," without warranties of any kind, to the extent permitted by law. Warranties specific to the Keel product itself (or the absence of them) are set out in the License Agreement, not repeated here.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Site or the purchase process. Our total liability under these Terms is capped at the amount you paid for your Order. This section doesn't limit or expand the separate liability terms in the License Agreement governing your use of the Product itself.
12. Indemnification
You agree to indemnify us against claims arising from your misuse of the Site, violation of these Terms, or content you submit through the contact form.
13. Termination
We may suspend or restrict your access to the Site or to repository access granted under an Order if you materially breach these Terms, including the acceptable-use restrictions in Section 4. Termination of Site access doesn't by itself revoke a validly purchased license to the Product, that's governed separately by the License Agreement.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute arising from these Terms will be resolved in the courts located in Delaware, unless applicable consumer-protection law in your jurisdiction requires otherwise.
15. Changes to terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision, continued use of the Site after a change means you accept the updated Terms. Material changes affecting existing license holders will be noted in the changelog.
